A Health & Welfare LPA lets you appoint someone you trust to make decisions about your medical treatment, daily care, and living arrangements if you ever lose the ability to decide for yourself.
Unlike a Property & Financial Affairs LPA, this document can only be used once you've lost mental capacity. That's why it's so important to get it in place while you're well — once capacity is lost, it's too late.
After signing, Aaron handles the full registration with the Office of the Public Guardian. Registration currently takes around 20 weeks, which is why starting sooner rather than later matters.

What's Not Included (Available If You Need Them)
- Medical capacity assessment — if there are concerns about your capacity, a formal medical opinion may be required. This is a third-party cost set by the GP or specialist (quoted separately)
- Complex or unusual instructions/restrictions — bespoke conditions beyond standard arrangements (quoted separately)
- Replacement of attorneys after registration (quoted separately)
- Changes to a registered LPA (quoted separately)
Your situation may be entirely straightforward and not require any of these.
What Happens If You Don't Act?
Without a Health & Welfare LPA, if you lose capacity, your family would need to apply to the Court of Protection for a deputyship order — a process that typically costs thousands of pounds, takes many months, and means a court-appointed deputy (who may not be the person you'd have chosen) makes decisions about your care, medical treatment, and living arrangements. An LPA at £550 + VAT costs a fraction of what a Court of Protection application would.

Required disclosures for Health & Welfare LPA
What is included: An initial consultation (in person or via video call) to take your instructions. Professional drafting of your Health & Welfare LPA by a qualified Solicitor. Aaron acts as Certificate Provider. A secondary meeting to oversee the formal signing and witnessing. Full OPG registration. Storage of your original documents (optional).
Our standard fixed fee applies to straightforward matters. Where complex issues arise — such as the need for a formal mental capacity assessment or medical report — additional charges and third-party disbursements may apply. We will always discuss and agree on these fees with you before proceeding.
Important Note: A separate client onboarding fee of £35 + VAT per person applies to all new instructions to cover ID verification and file setup.
